Well, I have 3 points on my license for speeding which are due to come off in May. Just when I'm looking forward to a clean license at last - they got me! I've been done for 50mph in a 40mph zone by a cop on the side of the road. I've been sent a form to receive a fixed penalty. Does anyone know how many points I will get if I send it back?

Yeah - as Jools says its 3. But I got 4 once for doing 40 in a 30!! So its not written in stone. Got a clean licence now though (he says with a smug expression!) CC

Fixed penalty is 3, they would have summonsed you if they wanted "blood". Sorry to here about that thats how they got me too!!

when I got my last NIP, I sent the ole letter from the MCN.They told me to go forth and multiply.sent an offer of a riding course which cost more than the fine.ignored that. They sent another NIP, ignored that.... waiting for a summons.They have 6 months from the date of the offence to issue the summons, and that's up in a couple of weeks.Might get lucky.

Another option = ignore the first letter.
They will write back after a month or so. You then claim you never got the original. They have to notify offences within 14 days and unless original letter was recorded delivery they cant prove it arrived, so cant prosecute.

The police have 17 days, including postal time, to get a NIP to the registered keeper of the vehicle. Even if it arrives late you cannot ignore the letter, as not providing the name of the rider/driver at the time of the offence, is in itself an offence and you could be prosecuted under Section 172 of the Road Traffic Act. ![:(](//storage.proboards.com/forum/images/smiley/sad.png) Jim

Putting my pedants hat on the NIP has to be *sent* within 17(?[1]) days. The _arrival_ time is not specified. (So if there's a postal strike you're not off the hook.)

No doubt added 3 days to allow enough time for 2nd class post to arrive.
Looks like they don't even need to *send* anything. Simply type up the letters with a convenient date and dump them in nearest builder's skip. Then proceed to baliffs to collect the cash. That would stand up nicely in court... M'lud.
If the post doesn't get the NIP to you, how can you reply? Could it be they send out NIP duplicates with red warnngs attached because of postal *reliability*?

Ask for a copy of the calibration certificate for the speed gun they used to catch you with.... your within your rights to see a copy of it. If they can't produce it then they can't prove it was accurate at the time they got you. ![;)](//storage.proboards.com/forum/images/smiley/wink.png)

When I was done 4 years ago I wrote to them and asked them for proof of callibration and a print of the photo that got me. The SP50 offence was in a car and on the M4. They told me that they do not issue callibration certificates on request but would do so if it went to court. They did however send me the photo. It was someone elses car - yippee! I wrote back to them and they said sorry here is a copy of your car and they then done me for 3 points and £60. A friend of mone contested it all the way to court. He reckoned there were problems with road markings, the camera site etc etc. When he got to court they said the police were correct and they fined him £180 (including costs) and gave him 6 points. he wasn't very happy! I decided to bite the bullet and resigned myself to the fact that I probably will never have a clean licence. I sent off my letter of guilt yesterday and now await the follow up. I suppose I am going to have to inform my insurance pretty soon. Ah well................ ![:'(](//storage.proboards.com/forum/images/smiley/cry.png)

The Magistrates guidelines say you should get no worse than the fixed penalty for the lower end of speeding offences. Are you sure he wasn't really tanking it and denied the chance of a FPN?

Can't remember the details excatly. It was a 40mph road that had beed reduced to 30mph quite recently before his offence. He was 62 years old and no mad hatter in a car so I would have been surprised if he was going very fast. He was offered a fixed penalty in the post but he declined.

I suppose they are just guidelines and allow for some flexibility. Perhaps he came across as awkward in court and they wanted to make an example. I don't know all the details and he doesn't work with me anymore so I can't ask him. Anyway, I've got my own points to worry about :mad:

When I was a nipper it was your forth endorsement rather than 12 points that got you banned.
I hadn't been very good and already had begged in court to not get banned for my 4th offence. I didn't fancy my chances when I was up for the 5th (40 in 30) & 6th (92 in 60) on the same day.
The Magistrate said that she took my grovelling explaination into consideration but due to the severity of the offenses and the fact that I had already been let off once I had to be banned for 9 months on each count.
My outburst at this point of "Thats a bit F***ing Steep" wasn't the ideal reaction!!
Result: Consecutive instead of concurrent terms
18 months of buses and walking. :doh:

Quiet Sunday morning passing a school near North Weald, tootling along on my old MZ Supa 5. Got the NIP about a week later, nice picture of the rear of me and the MZ! Held my hand up and returned the NIP.
FOUR POINTS and a £60 fine. It does happen.
